Trusts and Estates
Study the essential legal requirements of last wills and testaments, trusts and estate planning. Procedures for the probate and administration of estates will be covered in detail. Prerequisite: PLG114 or consent of program director.

Course Learning Outcomes:
1. Describe the benefits of a last will and testament.
2. Draft a last will and testament with a self-proving affidavit.
3. Explain the legal implications of dying without a will.
4. Explain the purpose of the principal tools available for state planning.
5. Differentiate probate property from non-probate property.
6. Determine the persons who would inherit property based upon the laws of intestate succession.
7. Define the legal concept “spousal right of election.
8. Describe the statutory requirement for executing a will.
9. Describe the grounds for contesting the probate of a will.
10. Describe the legal requirements for various types of trusts.
11. Apply the Code of Professional Responsibility to a legal problem.
12. Draft the proper forms for a probate proceeding, an administration proceeding or a small estate proceeding.
13. Draft a variety of tax returns (income, fiduciary, estate tax, etc.).
